According to the Transfer of Property Act, a registered instrument or document signed by or on behalf of the person gifting the property and attested by at least two witnesses must be used to effectuate the transfer of a dwelling property under a gift. When a gift deed or other document is given for registration, the registrar must confirm that the appropriate stamp duty has been applied.
